A rear-end collision establishes negligence on the part of the
operator of the rear vehicle by Lauren Kanter, Esq.
Cristina Duran
was traveling in traffic on Westchester's Cross County Parkway at approximately 20 miles per hour and
one car length behind the vehicle in front of her when she briefly took her
eyes off the road. When she turned her
attention back to the road, the car in front of her, occupied by Naim
Musharbash and Ayman Musharbash, was stopped.
Ms. Duran hit her brakes but was unable to stop in time. Her vehicle finally stopped - underneath the
bumper of the preceding car.
Claiming permanent back
injuries and decreased range of motion due to the November 2004 crash, the
Musharbashes brought a personal injury action against Ms. Duran and the
vehicle's owner, Angel Duran.

You've Won. But now what? by Eryn Y. Deblois, Esq.
Obtaining
a judgment is half the battle, collecting on the judgment is the other.
Whether a judgment has been obtained because the defendant
has defaulted (there was no appearance or answer), or because you have won at
trial, the most important first step is to obtain a judgment. Securing a judgment generally provides you
with an official decision of a court that a monetary amount to due by the
defendant. However, the enforcement of a
judgment is not handled by the court.
Instead, it is left in the hands of the winning party.

denied defendants' motion for a protective order from conducting discovery in
the Agape World civil RICO matter. Joe Campolo is representing the plaintiffs
in this action.
